Our position

The right to be a parent should never depend on gender. We advocate for laws that protect every child's right to have both parents actively involved in their life and that impose meaningful consequences on anyone who deliberately prevents a child from maintaining a relationship with the other parent.

About the association

The association „POKRET RODITELJSKI FRONT" is a non-governmental, non-profit organization founded to advance the protection of family rights, equal parenting and the rights of the child.

The goals of the association are:
  • promoting and protecting equal parenting, with special emphasis on fathers' rights;
  • supporting single parents and parents who have lost a spouse;
  • protecting vulnerable mothers in exercising parental rights;
  • legal and social protection of children living in risky, neglected or abusive conditions;
  • educating the public on the importance of equal parenting and family values;
  • initiating changes to laws and practices in favor of the child and the family.

Our mission

„No one who fights for their child should ever have to stand alone against the system.”

Whether through child abduction or the misuse of the justice system, anyone who deliberately deprives a child of a relationship with the other parent must face serious legal consequences. A child must never be used as a weapon in a conflict between parents.

We are the voice of those whose fight for justice has been ignored for far too long. We strive for a society in which every child grows up with the love, care, and presence of both parents, because family is a child's right—not a privilege granted by the system.

Why it is time for change

Children have the right to both parents.

When parents divorce, children should not lose one parent. Unfortunately, in our system children most often stay with the mother — even when there are serious reasons why that should not be the case.

A parent who obstructs contact often uses the child as a weapon — as a means of pressure, blackmail or revenge. The other parent fights for months or years just to see their child, while the system looks the other way.

Six things every parent must know before entering the courtroom. This is not a substitute for a lawyer — but a first map through the system.

01Family Act of the RS · Art. 6, 60–61

A child has the right to both parents

The law explicitly states that a child has the right to maintain personal relations with the parent they do not live with. Preventing contact violates the child's rights — not only the parent's. Request a written explanation for every refusal.

02Enforcement Act · Art. 367–375

Enforcement of contact is mandatory

If the other party does not respect the court's decision on contact, file a motion for enforcement. The court can impose a monetary fine in enforcement proceedings — the amount is not limited and can be significantly higher than RSD 200,000 — or change the custody model in favor of the non-obstructing parent.

03Family Act · Art. 75–77

Joint exercise of parental rights

Parents can agree to jointly exercise parental rights. The agreement is certified and submitted to the court — this is the fastest and cheapest path to a fair arrangement.

04Practical advice

Document everything — in writing, with dates

Keep a journal: every attempt at contact, SMS, call, email. Recordings and messages are valid evidence in court. Without documentation, your story is just one word against another.

Abduction of a minor

Withholding a child by one parent contrary to a court decision is a criminal offense — punishable by up to 3 years in prison. False reports of violence are also a criminal offense (Art. 334 of the Criminal Code).

06Family Act of the RS · Art. 64–65

Hearing the child — a law that harms

The law lets a child over 10 speak in court. But an alienated child is often indoctrinated to hate the other parent — their words are not their own. The court must recognize alienation, not ask the victim to confirm the crime.

Global models

The law must change — and align with the standards of leading nations.

In Western European countries, children of divorced parents do not automatically lose one parent. Joint custody is the rule, not the exception. Every country must follow that example — including Serbia.

SELaw since 1998

Sweden

Joint custody has been the legal rule since 1998. The child has the right to both parents as a basic presumption — the court awards sole custody only in exceptional cases.

DKLaw since 2007

Denmark

Joint parental responsibility is the default after divorce. The court can revoke it only if there are serious reasons. Children have an active say from the age of 10.

BELaw since 2006

Belgium

The 2006 family law replaced the term 'custody' with 'parental authority', equal between mother and father. The rule is 50/50 joint exercise of rights.

NLLaw since 2009

Netherlands

The 2009 parenting-plan law requires parents to reach an agreement on the visitation schedule. The court favors models that maintain the relationship with both parents.

DELaw since 1997

Germany

Joint parental responsibility is the legal presumption even after divorce. The child has the right to contact with both parents — obstructing contact is legally punishable.

ATLaw since 2013

Austria

Joint custody became the rule after divorce in 2013. The law abolished the automatic award of custody to the mother. The model is balance, not the victory of one side.

What are my rights if my ex-partner won't let me see my child?

A child has the legal right to contact with both parents. If your contact is being obstructed, you can request enforcement of the court decision and a change to the visitation model. Reach out to us — the first contact and consultation are free.

How is the child visitation model determined in Serbia?

The visitation model is set by agreement between the parents or by court decision, in the best interest of the child. The court considers the child's age and relationship with each parent, but the goal is for the child to keep a close bond with both parents.

What is meant by parental alienation?

It describes a pattern of behaviour, not an official medical diagnosis. It refers to situations where one parent systematically undermines the child's relationship with the other parent — through disparagement, conditioning, blackmail or obstruction of contact. Experts disagree on the label, but agree that such behaviour harms the child and should be considered by courts when deciding on contact arrangements.
